EXPLORE FENCING CPD COURSE TERMS AND CONDITIONS 2023
1. Definitions:
a) British Fencing (known as BF), the National Governing Body of fencing in the United Kingdom.
b) BF LearningZone: The online platform where BF courses take place and where users are enrolled upon joining a BF course.
c) LearningZone Credentials: The login credentials provided to users to access the BF LearningZone.
d) Access Duration: The period of two months during which users have access to the Explore Fencing course on the BF LearningZone, starting from the date they receive their LearningZone credentials.
e) Continued Access: Users will still have access to the BF LearningZone even after the Explore Fencing course ends, allowing them to access other courses from BF. However, BF reserves the right to remove users from the LearningZone.
f) Payment: Confirmation of a booking is subject to the full payment of the required amount.
g) Age Restriction: The Explore Fencing CPD online course is available only to individuals who are 18 years old and above.
h) Digital Certificate: Upon completion of the Explore Fencing course, users will receive a digital certificate downloadable from the BF LearningZone. The certificate is valid for 2 years from the date of issue.
i) Qualification Progression: Explore Fencing is the first stage of a larger qualification called Core Coach. The Explore Fencing certificate is a certificate of completion, which can be accepted as prior learning for those who choose to progress to the full Online Core Coach course.
j) Cost Accountability: British Fencing will not be held responsible for any costs incurred by users in relation to their participation in the course.
k) Privacy Policy: Users agree to British Fencing’s Privacy Policy by agreeing to these terms and conditions.
l) Cancellation: Cancellation terms apply to confirmed bookings in accordance with the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.
2. Scope of Service and User Accounts:
a) BF courses take place on our online BF LearningZone platform. When joining a BF course, you are enrolled onto the BF LearningZone. Full details about the Explore Fencing Online course and instructions on how to sign into British Fencing’s LearningZone will be sent by email.
b) BF will aim to set you up with your LearningZone credentials as soon as possible. Enrolments on to the online platform will usually be completed on Monday of each week, although BF will try to exceed this.
c) Your access to the Explore Fencing course on the BF LearningZone will remain active for two months from the date you receive your BF LearningZone enrolment credentials.
d) The BF LearningZone will still be available to you after the Explore Fencing course has finished, so you can access other courses from BF in the future. BF reserves the right to remove users from the BF LearningZone.
e) After you complete Explore Fencing, you will receive a digital certificate which can be downloaded from the BF LearningZone. The certificate is valid for 2 years from the date of issue. We encourage users to download their certificate as soon as possible, to ensure they have access to it in the future.
3. Disclaimer of Liability:
a) BF is not responsible for any direct or indirect damages or losses incurred by the user, and that the eLearning product is provided on an “as is” basis.
b) Explore Fencing CPD online course is available to people 18 years old and over.
c) Your booking will not be confirmed unless payment for the full amount has been received.
d) You will not be a fully qualified fencing coach at the end of Explore Fencing. However, Explore Fencing is Stage 1 of a larger, 3-stage qualification called Core Coach. Your Explore Fencing certificate will be accepted as prior learning if you choose to progress to the full Online Core Coach course.
e) British Fencing will not be held accountable for any costs incurred for your participation in this course.
4. Governing Law and Jurisdiction:
a) These terms and conditions, and any disputes arising out of, or in connection with them, shall be governed by and construed in accordance with the courts of England and Wales within the United Kingdom.
b) Any dispute, controversy, or claim arising out of or relating to these terms and conditions, including the validity, interpretation, breach, or termination thereof, or any non-contractual dispute or claim, shall be subject to the exclusive jurisdiction of the courts of England & Wales within the United Kingdom.
5. Intellectual Property:
(a) Ownership: All intellectual property rights, including but not limited to copyrights, trademarks, patents, trade secrets, and any other proprietary rights, associated with our eLearning product and its content (collectively referred to as the Explore Fencing course), are and shall remain the exclusive property of British Fencing or its licensors.
(b) Restrictions: You acknowledge and agree that the Intellectual Property is protected by applicable intellectual property laws, and you shall not acquire any ownership rights or interests in the Intellectual Property through your use of our eLearning product. You are expressly prohibited from:
i) Copying, reproducing, or distributing the content or materials from our eLearning product without our prior written consent.
ii) Modifying, adapting, translating, or creating derivative works based on the content or materials from our eLearning product.
iii) Selling, renting, licensing, or sublicensing the content or materials from our eLearning product to any third party.
iv) Removing, altering, or obfuscating any copyright notices, trademarks, or other proprietary rights notices contained within the content or materials from our eLearning product.
6. Unauthorised Use:
Any unauthorised use or infringement of our Intellectual Property may violate applicable laws and could result in civil and criminal penalties. We reserve the right to take appropriate legal action to protect our Intellectual Property and enforce our rights.
7. User Content:
You retain ownership of any original content you create or upload to our eLearning product. However, by submitting or uploading such content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, and distribute that content for the purpose of providing and improving our eLearning product.
8. Payment Terms:
a) Price Variations: The pricing for our eLearning product may vary depending on the region or country where the purchase is made. Different pricing tiers or currency conversions may be applied to accommodate local market conditions, tax regulations, or other factors.
b) Displayed Prices: The prices displayed on our website or other sales channels are indicative and may not reflect the final price applicable to your specific region. The actual price you will be charged will be clearly communicated to you during the checkout process based on your selected location or billing address.
c) Currency Conversion: If you are purchasing our eLearning product from a region with a currency different from the currency indicated on our website, the final price may be subject to currency conversion by your payment provider or financial institution. In such cases, the converted amount may include additional fees or charges imposed by the payment provider or financial institution, for which we are not responsible.
d) Taxes and Duties: The prices stated on our website or during the checkout process may or may not include applicable taxes, customs duties, or other similar charges. Any additional taxes or duties required by your local jurisdiction may be added to the final price and displayed to you before completing the purchase.
e) Price Changes: We reserve the right to modify the pricing of our eLearning product at any time, without prior notice. However, any price changes will not affect the price of a product already purchased by you.
f) Please review the final pricing information provided during the checkout process carefully before completing your purchase. If you have any questions or concerns regarding pricing, currency conversion, or additional charges, please contact our customer support for clarification.
9. Privacy and Data Protection:
(a) Data protection means all applicable data protection and privacy legislation in force from time to time in the UK including without limitation: the UK GDPR (as defined in the Data Protection Act 2018); the Data Protection Act 2018; the Privacy and Electronic Communications Regulations 2003 (SI 2003/2426); the General Data Protection Regulation ((EU) 2016/679) (to the extent applicable) as updated and amended from time to time.
(b) By agreeing to these Terms and Conditions, you also agree with the British Fencing Privacy Policy.

BF is not responsible for any direct or indirect damages or losses incurred by the user. This eLearning product is provided on an “as is” basis.
11. Modifications to Terms:
BF reserves the right to modify the terms and conditions and we will email all current users (as defined by 1. (d) above) who are active in using the product, as well as update this terms and conditions page. A commentary at the bottom of this page will highlight the key changes.
12. Cancellation:
Once a confirmed booking has been made, cancellation terms apply, in line with the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.
You can cancel your booking within a 14-day cooling-off period from when the transaction has been completed.
A refund (net of any finance charges incurred) will be issued if all the following apply:
You have requested a refund in writing within the 14-day cooling-off period.
You have not completed or attempted to complete the course and any tests.
You have not received a certificate of completion for the course.
In the event where access to the BF LearningZone is disrupted, for example, due to technical issues, we will communicate a remedy that reflects the situation.
